2 point down in 2 weeks after the original award was created by Joy23
Hi guys,
BIG THANK YOU for your help over the years!
I was over 10 years on the highest rate on DLA, not least thanks to you and your guides.I had to move from DLA to PIP in 2019. I did it successfully thanks to your guides again.
On 23 December 2019 I was awarded the highest rate on both daily needs and mobility needs for PIP from Jan'20 to Nov'22. My medical was at home, due to recent TRKR operation at the end of October, and in the light of the successful result for PIP in December'19 I did not ask for a copy of that so far.
However, on 10 January, unexpectedly, I received another letter from DWP, stating that the first award was due to an error and now my daily needs rate goes back to standard. For no apperant reason, they took away 2 from the originally awarded 4 points from the section "Managing your treatment", downing my overall result from 13 to 11 points. This cost me £28.95 a week. I don't have any other income. I am waiting for another 3 joint replacement operations on both my hips and my left knee. I use wheelchair. I have other conditions as well, which I dont want to discuss on here. My circumstances haven't changed in over a decade. To say I am disappointed will be major understatement.
I would like to ask is there any other similar to my case? Why would DWP look into my documents in just few weeks time from the fist decision? Is it even legal to do that?? Its obvious they were trying to take away money from me. Its nasty and unfair. How would they calculate to take away exactly 2 points from the original 4?? They do not explain this in any shape or form, just inform me they did it. I am confused now as to should I apply for Mandatory Reconsideration Notice, as I feel they want to trick me into doing that and take away all my PIP benefit.
Any advice will be highly appreciated.
Thank you.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Hi Joy121
I'm sorry this has happened to you. I have not heard of anyone saying that there has been a mistake in this way. It is certainly not 'illegal' for them to decide that a mistake was made.
I don't know whether you have a copy of your original assessment report. If you didn't you need to get it. If you did get it, then you need to ring the DWP and find out where they took the two points from and request in writing the reasoning behind it. When you have the reasoning behind the decision you will find out what is behind it and whether you want to put in for an MR.

Thank you, BIS
I will follow your suggestion and will take it from there.
I don't think they will reverse the decision back, but at least I will have more info and decide how to proceed.
