Hi all can anyone help I’ve had DLA since 1997 with low mobility and high for other I have epilepsy which can be really bad and also have and aneurysm in my brain which has had stents and coils and a flow diverter to keep it stable been moved to PIP and awarded the enhanced mobility rate but completely turned down for the PIP payment don’t know how I’m going to manage now as I have also had my severe disability payments with ESA taken off me I need that money to get back and forth to hospital in Cardiff as I’m in Swansea does anyone think I would get it if I appealed thanks all

I'm slightly puzzled by what you have written. You say you were moved from DLA to PIp and were awarded 'enhanced mobility rate' but then you say you were 'completely turned down for the PIP payment.' Did you receive mobility but no daily living or did you not receive an award at all?

If you wish to challenge the decision the first stage is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help. It isn't so much about the conditions that you have, more about you explain the impact on your life with regards to the PIP criteria.

Hi thanks for your reply sorry for my messy post new to this as I have never had a problem before with assessment I was awarded the enhanced mobility but no daily living at all which I really don’t understand as my health has not improved but got much worse thanks

Hi Gaynor

Thanks for the clarification. You can challenge the decision as I said in my previous post. But get that report and see what went wrong. Be aware when you request an MR - they look at the whole award, not part of it.
