Hello
I have finally got my date for the 29th of January, 13 days of living in high anxiety. I have got a friend who is open to accompanying me, however, she cannot do this date due to work commitments. Is it acceptable to request a delay at this late stage? I have had one hearing initially to deal with my case without me knowing about this. The appeals said they would not hear my case until I was present. My anxiety would not allow me to go unless I have an escort.
Secondly, I have new evidence only received yesterday, and still waiting on a biopsy result. Should I call them and ask for an extension? To be honest I really can't go alone.
If I am still waiting on other evidence, shall I just tell them?
They can see from my notes that the health issues I am challenging, have been with me for 4 decades, but just got worse with age.
In the report from the pip, assessment is filled with untruths. Is it a case I have to cross-reference the lies.
I have a friend that can do this with me.
Finally, can they talk for me, as I am sure to burst into a panic attack and tears.
My claim was started in October 2018. I just feel like giving up, this has increased my mental health.

I think it unlikely that the hearing will be adjourned but you lose nothing by making the request, I would do it on the basis of your companion not being available and there being no one else who can attend with you. I would not use the evidence as a reason as the Judge is likely to take the view that you have had plenty of time to provide everything you want to be considered by the panel.

Send the new evidence immediately to the Tribunal Service or you risk it being excluded, you do know that they can only consider your conditions and limitations as they were at the time that the Decision was made?

It is unlikely that they will ask for you to comment on the assessment report, this would have been something to have included in your submission.

The questioning will be directed at you, your friend may be allowed to make a comment on the end but they will not be allowed to speak on your behalf.

Just because the Judge has said that you should attend does not mean that you have to, you still have the choice of opting for a Paper hearing.
