DWP settlement offer withdrawn AFTER hearing was created by HJH
Help! I negotiated an agreement to increase daily living points from 9 to 13, and extend the term of the pip award from 2 to 6 years. This was agreed with the DWP rep at 4pm, yesterday. I made contemporaneous notes, emailed the offer to my son, he replied yes, the DWP rep called me back, I reconfirmed the specific terms with her, she explained she couldn’t email me the offer but it was agreed and the letter would be sent out today. The appeal hearing was due to take place at 10am this morning. On the basis of the offer, I emailed the tribunal to withdraw our appeal, noting the terms of the agreement. At 11,30 this morning I had another, unexpected, call from someone else at the DWP who said they were not sticking to the first agreement and the term had been decreased to 5 years. She relied on the fact that I had nothing in writing confirming the offer yesterday. She is not reneging on the points,
Has anyone else had this situation occur? I am absolutely gobsmacked. I’ve spoken to the tribunal call centre who told me to email explaining what has happened. Any ideas what I can do?
Many thanks in advance. Hh

Hi HJH
There isn't a lot you can do about it apart from putting in a formal complaint or reject the second offer which I suspect you don't want to do because you would then have to go to a tribunal and you could wait a long time for it.

I rang the Tribunal to ask if it could be reinstated, and was told to email with the whole sorry tale. I threatened to judicially review the DWP as well. 4 hours later I had a phone call from a senior DWP appeals person who had a call from the Tribunal. She apologised profusely and told me it had been a “mistake” and they have now sent out an amended decision for the full 6 years. The tribunal have adjourned us until we receive the written offer and are happy it is what we agreed. Looks like the Tribunal service saved the day!

Hi HJH
So glad to hear of a positive outcome. It was you who saved the day by chasing it up!
