After waiting 9 weeks 2 days, the dreaded brown envelope dropped on my doormat today, after getting help with my mandatory reconsideration for pip from fightback4justice, my points have remained exactly the same zero for everything that was disputed, giving me a grand total of zero points across the board, to say I'm upset and fuming is an understatement, I don't believe they've even looked at it as the letter was dated the same day I rung to see if it had been logged and was told by the call handler that it had been given to a dm that very morning, I believe its been skimmed over and rubber stamped, I'm sick of this whole process this will be the second time I go to tribunal for pip, first time was after an unsuccessful transfer from dla indefinite award again scoring zero points, thats if I decide to go for a tribunal at all, I'm not sure if the stress of it all is worth damaging my mental health any further than it all ready is, sorry for rant just need to get it of my chest

Hi Shellyj79

Sorry to hear about your bad news, unfortunately you are not alone, I come across this on a regular basis and not just on this forum, the next stage is to put in an appeal.

I recently put in an appeal (Nov 2019) for one of our customers as she got zero points for both the assessment and the MR, we heard today without going to the Tribunal that the DWP had re-assessed her claim and awarded her the enhanced daily living and standard mobility, we had hoped for the standard on both components. So don't give up and use the guides on this forum which are well written.

Shellyj79, if you give up now you're doing exactly what they want. Give yourself a couple of days to let your initial reaction settle and then you may feel differently. I find I often change my views once I've had a chance to process things.
I've read several times of late of claimants receiving a phone call before their case goes to the tribunal and receiving an award offer so the DWP is clearly trying to avoid tribunals where possible.

Thank you Gary and Becky for you kind words, after talking things through with my mom and dad, who are very supportive and have basically told me I must fight this again, because I quote 'they can't get away with this' especially after them both reading the mandatory reconsideration letter and seeing the underhand comments about my illnesses and their reasons for not awarding me, I am going to go to tribunal, so let the battle commence, again.

Hi Shellyj79

Good for you, don't forget to use our guides when appealing the decision on line or using SSCS1 form.

I always use the SSCS1 form as if I am writing a MR, follow our guides as they are well written.

Understand that the assessor is offering an opinion when they say that you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions.

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.
