If you move house do you have to go on UC?

I heard recently any change of circumstances means you have to go on to Universal Credit if you are on ESA or other non UC benefits.
Although I know in the last year or two if you moved house within the same council you would remain on ESA and not have to go on Universal Credit.

Do we know if this still applies?

There have been no changes to the rules surrounding having to claim UC. Only changes where a new claim for one of the benefits that come under the UC umbrella will result in a transfer to UC unless the claimant is in receipt of the Severe Disability Premium, in which case you are barred from claiming UC and would be able to make a new claim for the legacy benefit.

If you move within the same Local Authority then you should not need to claim UC.

If you move to another LA then you and need to make a new claim for Housing Benefit then this will trigger a transfer to UC unless you are currently in receipt of the SD Premium.

Hi, I've been fishing about too as we want to move and it WILL be to a new LA. As I get the high rate of care on DLA, I'm entitled to this enhanced dis. Premium, we will also be moving into sheltered accommodation which is classed as 'specialist' housing.

I don't think we would manage if I lost my disability benefits though, we'd be completely stuffed!!!

Hi Sallyb

enhanced disability premium is different from SDP, To be eligible for the Severe Disability Premium you need to meet the following criteria;

- You need to be receiving or entitled to (with the SDP) Income Related ESA
- You need to be receiving a qualifying benefit such as a PIP Daily Living award (there are other benefits)
- You need to be living alone or considered to be living alone unless you have a partner who also receives a qualifying benefit.
- No one must be receiving Carers Allowance against the qualifying benefit

If you meet all of the requirements then contact the DWP office dealing with your ESA claim and ask to complete an IS10 form, this captures details about the above and will allow the DWP to make a Decision about whether you are eligible for the Premium.

Unfortunately moving into sheltered accomodation you may still have to apply for UC unless you are moving within the same local authority area or you are exempt. Most supported housing housing is exempt but not sheltered, so check it out. I have come across this issue many times which has caused lots of problems with rent arrears resulting in SPO's, threat of eviction and stress.

Your DLA will not change but if you are in receipt of ESA and you do not qualify for a SDP then you will have to apply for UC, seek help from your local welfare rights unit to clarify your situation and make sure you get the correct benefit advice.
