Hi everyone,

I wish to be OTT but this whole PIPr review as caused my partner and me to argue :(
Yesterday I received a letter from the PIP to say they have all the required info and will make a decision on my claim. I want to call the DWP on Monday to ask for a copy of the assessment report. This is so I'm able to look at the report and make a start in responding to anything that I believe to be inaccurate within their report.

Partner things I'm jumping the gun and should wait until I receive the outcome from the DWP.

He thinks I may I upset (there not the words he used) the DWP DM by requesting the assessment. Or we may believe in reading the assessment that we may come to the incorrect conclusion of the outcome. I guess we are simply getting our knickers in a twist. But the decision will have a massive impact on our lives.

I can't tell you how stressful this whole situation as been. I'm feeling negative as it appears so many claimants going from DLA to PIPlose their benefit and have to go down the appeals route.

I don't understand how many appealing have some form of reinstatement of their benefit on appeal. This figure appears to be reasonably high. Therefore why have the DWP not addressed this issue, surely it must cost thousands for all the appeals?

The MR in many cases seems a waste of time from reading the forum. The appeal takes months I'm not sure we could manage without my benefit and I'm not sure I wan the stress of dealing with an appeal process that can take months.

Is there an average window from receiving the DWP letter saying we have all the info to their decision letter?

Hi ukLee

You are quite right when you talk about getting a copy of the assessors report as soon as possible.

The assessors are supposed to load up their reports within 48 hours of a face to face. You should be able to ring up any time after that to request a copy of the report, we usually advise 2-3 days after your assessment.

There is a small window for you to write to the Decision Maker if you believe that the report contains a number of inaccuracies but you will need to be quick.

Understand that the assessor is offering an opinion when they say that you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors. Lastly, make sure that your letter makes it clear that you are not requesting a Mandatory Reconsideration but you reserve the right to do so once a Decision has been made.

Thanks, I will call them tomorrow for the report. I think like many I put my head in the sand and am scared to face the situation. Why I have no idea because I have an illness which affects me daily.

I've used your guide here in completing the forms which were helpful.

Just to say a few things from personal experience:
A) Do get your assessment report ASAP. It is 30 pages long and to launch any complaint/appeal you need to know what errors, inaccuracies or evidence not considered there are. I also find it helpful to be able to consider the report separately from the DWP decision since they are different. Also, if you feel you need to get more evidence the more time you have to do so the better.
B) Do go for the MR as on my transfer from DLA to PIP the original decision was altered at that stage.
C) Also remember that one of the main ways of saving money is to put people off contesting decisions. There is a great temptation to just give up!

Thanks for the advice will call them tomorrow and request the report. I going to pre-empty the DWP decision and start to read the report and state in writing what I consider to be incorrect or information which is not relayed in the report. That way it's ready to send back for an MR straight away. God knows why I'm being so gloomy.

I can't believe more MPs arent asking why the appeal rate is high -there's something very wrong at the initial stages.
