Hi - Apologies if this question has been asked before or this post is in the wrong place

I have just been awarded zero points for my PIP application and I am preparing my Mandatory Reconsideration letter. I recorded the interview secretly on my phone because part of my condition is that my memory is now terrible. The assesor basically told a pack of lies in her report and I am confident of winning the appeal (at some stage) but wanted to know if it was worth letting them know that I had a record of the interview. Could this go against me in the appeal process or would it work in my favour that I have a record of the assessor's dishonesty/incompetence? Should I include this information in the MR?

Amazingly, I was recently placed in the support group for ESA at the first hurdle (many thanks to you lot for this btw) but asked if the medical interview could be recorded. They said it could but when I got there the assessor knew nothing about it and the medical proceeded anyway. This was why I recorded the PIP assessment.

Any help much appreciated.

In regards to you covertly recording your assessment we cannot advise you either way, but there have been a number of threads on this forum where members have talked about convertly recording their assessment, I am also aware of a Tribunal where a convertly recording message was used as evidence.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP Mandatory Reconsideration & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report ( if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

Just for info' for any future claims: there is an excellent template letter on this site for requesting a recording of WCA for ESA - best to include it with ESA50 when you return it.
