hi everyone. We currently get tax and working tax credits. I have been on the sick for nearly 22 wks. we were working 16 hrs each. I am not going back to work and would like to claim ESA, but I am worried that I will have to claim uc.I have not informed tax credits yet because I am worried. Could someone give me some advice please

Hi tony

You can claim SSP for up to 28 weeks www.gov.uk/statutory-sick-pay after which you either claim New Style ESA www.gov.uk/statutory-sick-pay depending on you NI contributions or UC.

As a couple you need to be working 24 hrs per week to be entitled to TC. I would advise you to seek advice from your local welfare rights unit, you can check by putting your information into one of the online benefit calculators, I usually use Turn2us as you can also contact their helpline.

hi Gary thanks for the reply. We get child and working tax as we have 3 children 16 12 and 5.my wife is also a full time student .working/child tax credits don't count student loans as income whereas UC do hence my reluctance to claim .Could you advise please

Providing you have at least 50 weeks of NI Contributions in both of the Tax Years 2017-2018 and 2018-2019 then you can make a claim for New Style ESA, this is a Contribution Based benefit so your household income, with the exception of any pension income you receive, is disregarded as are your assets and savings.
