Hi , due to past expierence in dealing with P.I.P . and unfortunately causing massive anxiety 3 different times over last 10 years , first time on dla , had to go to tribunal eventually won … 2nd time on transfer from dla to pip , had to go to tribunal , eventually won but took half mobility away , this caused massive problems of my halth again big anxiety , so here iam now having notified them that my condition had changed dramaticaklly due to bad stroke and major vascular surgery , the problem I encountered was when I notified them of change of condition , "I still had 9/10 mths to go on existing award i.e. 3 year review , "may 2020" then I was told you have to completely re apply ???? so did this last year ,,, filled all forms in ,,,had face to face assessment , then 4 weeks after that ( October 2019) got letter saying they had all info they needed and decision will be made and they will let me know so since middle of January 2020 have rang them 3 times they keep giving excuses "they are behind with Octobers claims etc etc etc ,,,more stress again and now the ankiety off haing to go to tribunal again as I am expect after I try m/r that its back to tribunal all over again . so fortunately now was recommend your site so joined a moth ago .. an now in possession of a C.I.V.E. as stroke left me with damaged eyesight so bad that only have 30% in one eye so lost driving licence etc etc . so sorry this is long as am not the best now tryin to type this all out ,,dso please bear with me ,,, what to to do when brown envelope comes and its not good so have to do a M/R advice on this neede please , still wainting now since October , am at end of my tether after all the pasdt problems with dealing with them over last8/10 yeas. please help .Mozz

Hi Mozz

I am sorry that you are experiencing such a stressful time. Unfortunately, it is true that many members have reported that they have been told there is a backlog of cases, so there is little you can do about it but wait and see and occasionally ringing to see what progress has been made with your case.

When you get your letter, if you have to put in for a mandatory reconsideration, then we have a guide on how to do this, but you're not there yet and I would wait until you actually get a decision rather than applying additional stress on yourself at this moment.'

Hi Bis, many thanks for fast reply . ok so I wait with baited breath for brown envelope , ok can I ask that now I believe I wont get enhanced mobility even thugh assessor scorded me fully , as I am 70 this year ,????? don't understand that as I don't have a mobility car as I lost mobility at tribunal lst time only got 9 points then , so had to go in debt to buy new car ???? anyway why wont I qualify for full payment then ???? don't understand that because just because I got a couple of years older I m penalised ??? surely there must be something within the human rights act that the DWP are penalising me by way of discrimination to younger people under pensioable age i.e. 65 ?????? mmm interesting where can I find the rules of dwp p.ip. when all the rules were chaned in 2016 ??? If you do not currently have a Mobility award then you cannot now be awarded one as you are over 65 or State Retirement Age, whichever is the higher.

This has always been the case for PIP, there was no change in 2016 and was also the case for DLA. I'm afraid there is no opportunity to pursue this on the basis of discrimination.

Good evening Gordon , many thanks for your reply testerday , at the last tribunal award of 9 points on mobility so standard , this time assessor indicates enhance e due to latest problems revieviewed, so if that the case wen get letter hopefully next week then what is position on patments on mobility i.e. enhance , will I be able to get a car off mobility or not , am 69 at this time , thanks mozz

I'm afraid the rule is that a Mobility award cannot be awarded as new or increased once the claimant has reached 65 or State Retirement Age, whichever is the higher so even if you meet the criteria for an Enhanced award it cannot be awarded.
