My support worker has spoken to A decision maker and they say "they have been given clarification from above that any case where it has not been in payment due to capital needs to make a new claim for benefit. "

are you aware of this CLARIFICATION?

I have been on ESA since 2010 in work related group on mental health grounds and 2 years ago my mum died left me some money and i paid off my mortgage and renovated my home (new windows bathroom ec)t and now it has been spent.
my support worker assured me i would not lose my claime and be on the higher pree 2017 payments but now they say "they have been given clarification from above that any case where it has not been in payment due to capital needs to make a new claim for benefit. " does that mean I have to make a new claim for universal credit and less benefit to live on? this is all new to my support worker and i am obviousley worried.

It is no longer possible to make a new claim for legacy ESA unless you were entitled to the Severe Disability Premium in the last 30 days, which you were not.

Your only choice is to claim Universal Credit. The rules for this are similar to ESA(IR) so you may receive the same as you did previously, in fact, the LCWRA rate, the UC equivalent of the ESA Support Group is actually higher.

Replied by patternbill on topic ESA they have been given clarification from above
thanks Gordon
the letter from the decision maker stated "there will be no change to your credits only award of esa"
is that good, bad or BS
I am in receipt of PIP standard rate no mobility
I was receiving basic + WRAG + Severe Disability Premium but i assume your comment is more the fact i have not been receiving it in the last 30 days as i have not been receiving anything for nearly 2 years.
thanks for the positive feedback on UC i had a dread that i would only get the Basic which is less the 2/3 (more like 1/2) what i was receiving before mum died.
My Welfare Case Supervisor to use her title, thinks i was due an ESA50 anyway and also the PIP forms so back into the sausage machine i go to get ground down and reminded of all the "coping stratergies" i use .
I hope this clarifies things and if it changes anything please let me know.
