I have received a letter to say my ESA is to go down by £38 per week on the 3rd June but didn't say why. I phoned DWP who couldn't tell me why either for quite some time, before saying it was because I am in a mixed age couple and my partner is of state pension age. They said the £38 was an estimate and we could lose more. I explained my partner has not drawn their state pension. They told me he would have to as they are 67 in Dec and to phone the pension service. We phoned the pension service who said they didn't have any rule that a person has to draw their pension and that is down to the DWPWe wanted to leave things as they are as we don't want to be worse off and are worried about losing our housing benefit. I tried to get benefit advice from elsewhere and was told I would lose my hoping benefit and would be worse off. I contacted Citizens Advice who just asked me what DWP said but couldn't help me any further. I don't know what to do next as if we claim the state pension we will lose housing benefit but if we do nothing we will lose ESA. I am very worried.

If you are receiving any Income Related ESA then the DWP are entitled to assume that your partner is receiving the State Pension even if they have opted not to do so, however, if he is not eligible to receive his pension until December then you should be asking why they are making a deduction now?

He is 67 in this December. He has heard nothing about his pension apart from a letter about a year ago stating that he could defer it and it would increase in value. He left it as we didn't want to lose ESA and be put onto Universal Credit and tried to get benefit advice but couldn't. The letter says the money will be deducted from June 3rd. He hasn't claimed pension. When I went onto ESA it was contribution bas ed when I was medically retired in 2005. I assume it's now income based. I don't know letter doesn't say but I think it will be topped up with income related ESA. I claim for us a c couple. We do not know what to do about pension. We don't want to claim it due to not knowing what implications will be and not getting any advice

One question I would ask is, you say you have been in receipt of CB ESA since 2005, am I correct in assuming that you are in the support group of ESA?

Yes in support group. Got contribution ESA when I finished work in 2005. I don't know what it is now. I assume income related I think.

It is very important to know what type of ESA you are receiving IR or CB, you do need to seek advice from a welfare rights specialist with knowledge of the benefits system.
ESA Decision do not include an end date or award length, the award is indefinite with scheduled reassessment.
Contribution Based ESA is based on the claimants previous NI Contribution history, if you met the criteria for ESA(CB) then it is automatically paid. It is usually only paid for up to one year unless you have been placed in the support group in which case the award is indefinite with scheduled reassessment until you reach SP age.
Income Related ESA is ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works.
You need to contact DWP and ask them what type of ESA you receive, although you should have received a renewal letter this year with your benefit increases details, usually on the last page.
