I had my PIP result last Friday 21st February 2020 I lost my daily living component at standard level but retained the mobility at enhanced for 5 years. I had initially decided to go for a mandatory reconsideration and phoned to say I would be doing so. However after reflecting and due to the stress and misery I withdrew this on 24th February and wrote to say I could not face it. I have uncontrolled epilepsy suffering between 70 and over 90 seizures a month as well as incontinece. I do not get any income related benefit and would not be entitled to any if I lose ESA which is contribution based due to the 20 years I worked and which I am due to be assessed for again in June or July this year. Could I ask for my mandatory reconsideration to be reapplied for on the PIP. And if by chance I was put into WRAG can I only get WRAG for a year I have had contribution based ESA since 2011. If I lose ESA as well as the daily living component of PIP I will be broke and entitled to nothing and am basically dreading this year now. I have involved my MP but I doubt it will do much good. I know this question is a bit involved but can never get a straight answer anywhere.

If you want to re-instate the MR then contact the DWP again, follow it up in writing.

If you are moved to the WRAG then you can only receive your ESA(CB) for 365 days assuming that you have not already spent any time in the WRAG.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
