Hello any advise kindly received.
After working full time and becoming unwell, having to stop for a few years, I did permitted work and now want to start again. I was self employed and had a accountant so I am very aware of informing the DWP of any changes etc. My question is. Discussing with my GP and consultant and family I cant deal with my house as its too much and too big and its making me feel overwhelmed and impacting on my condition. I feel better when I am away from it and my career will allow me to look after myself and work under the 16 hours as I teach meditation and self care which I will absolutely make the DWP be aware of my limitations and that this is a test trade which I was told you are allowed up to 26 weeks and that my work will help me with my illness and I can detail any problems that arise in the course of the my work ie working flexible hours and this will be useful if the DWP come at me !! to access again . I also want to rent my home as it is far too much for me to deal with and my main objective to care for myself and my line of work allows me to undertake this. I know that my home will be classed as income as it was last time and I received contribution based esa and PIP. I dont get any help towards my mortgage and the local council I have informed and they said I will need let the DWP know which I knew already.
What will happen if I dont have a stable fixed address ? as my family and friends want me to stay with them so I can look after myself and do my meditation classes and not have a house to care for, its killing me !! and making me unwell and making me feel overwhelmed causing me to feel depressed and to be honest its impacting on my mental an physical well-being. Im very positive about my business and moving forward working part time for myself, but feel trapped as how my claim will be affected not having a stable address. They will know about my job, home etc.... done this before but its the address issue which I need to advice or signpost for advise to. I could use a relative . My friend has a holiday caravan and said this would help me with my management and wellbeing but its not a fixed abode. Would this open up a can of worms if its not in the same area, would
they make me reclaim..... or if stay with a relative in my area just a change of address. My brother is retired. I just dont want to make it complicated as I have had a nightmare dealing with the DWP in the past and thats another story resulting in them being investigated as they lost all my medical evidence twice and it resulted in the Independent case examiner. I was awarded compensation due to their unbelievable errors and impact on state of health well being and nearly losing my home, My MP was involved so as you can imagine I just dont want to deal with them again. Shelter said it could push them to change to UC. I am in the support group and enhanced rate of PIP. I have good support from my family and friends.

There must be people out there who dont own their own homes or rent a house but live with relatives or friends when they are unwell even homeless people sadly even people like me cant look after their homes anymore and its impacting on their wellbeing so they move out . They must have some sort of functional system in place claimants who cant live in their own homes.

Thank you in advance quite a bit complicated

It should be possible for you to nominate an address for any correspondence just be open with the DWP about what is happening.

If you are not living in the house then it will become an asset that and any rental income you receive will almost certainly prevent your receiving an Income Related benefit such as ESA(IR), Housing Benefit or even Universal Credit.

If you are only receiving Contribution Based ESA then I would not expect it to be affected by the changes.

If you are doing Permitted Work still then make sure that you stay within both the hours and earnings limit, be aware the PW limit is not 16 hours, it is less than 16 hours, so 15 hours and 59 minutes is OK, we have seen other members caught out by this.

Thank you Gordan. I was thinking about contacting the DWP today to ask if they have any idea of when my next esa assessment or esa 50 form coming as they did mention on the phone last year it could be April onwards this year, if I ring today could it generate a response from them to look into my claim again which of course I understand will come but I just dont want it all right now, if I inform them I am going starting permitted work later this year or am I look too far ahead or overthinking the way their system works but I will state at first I am just asking for information at this present time, no change of circumstances presently till I inform them otherwise. I receive pip till November 2020. I had such a traumatic time with them resulting in ICE investigating them. Plus believe me the report ICE did shows the phone conversations I had with them and the person dealing with my claim saying otherwise. Thankfully the investigation showed this. I just dont trust them to be helpful or give me the correct information to go forward, also if I had my brothers address as my home he is retired received his state pension and get the higher level DLA ,would it affect his income. I understand it would change his council tax help as I will be residing with him and I will pay this but would it affect his benefit amount . He owed his home outright no mortgage. Thank you very much for your help.

Hello Gordon just to add to my last enquiry , Scope mentioned just asking the DWP to ask that I still use my home as a care of address but dont live there as I am staying with relatives as a temporary nature while starting permitted work as this is the whole point in self care and management of my condition and I know there is a section that allowed work to be started as a test trade for up to 26 weeks which may not lead them to looking at my claim straight away. I make them understand that any work I do has limitation and I will keep a diary to show them at my next assessment any problems that arise in the course of my work . Thank you

There is no reason why your contacting the ESA Helpline will initiate an assessment, the staff that you will be talking to have no authority to start this process.

If you are no planning of starting any PW immediately then I would not mention it, you risk your intentions being misunderstood, wait until you are actually planning to start.

If you Brother is receiving the Severe Disability Element as part of any Pension Credit he receives then your registering to be at his address will probably mean that he will lose this, about £65/week.

Hello Gordon thank you for all your advise on my query. Not sure if you got the last message that I did contact the DWP today with my line of questions. My computer went funny so will just reiterate a few things that were said to me by the adviser. She stated that a care of address was fine as a correspondence address, and different to staying with someone, she said if you stayed with your relatives who both work, I will lose the severe premium of esa and its a care of address, I wont ........... told her she needs to be clear on this....... I asked if there is a functional system in this case and that it what she said and that it would not affect anyone at that address. I explained renting my home also permitted self employment. I asked when I might here from them regarding my esa claim as its nearly 3 years amd I know I am due anytime soon she said maybe May onward........ do you think its best to wait to fill in the form or wait for assessment if they do it or just start permitted work when I am absolutely clear on how this will impact my benefit . It will take a few months for me to sort everything anyway. You stated that my brother would lose £65 as he gets higher rate DLA , she just said he wont lose anything nor will I !!!......... asked her this few times !!! ....if I live with family who dont have any type of benefit this is when have recalculation. Then she said if you use your home as your same residential address but dont live there , nothing will change I would just have a care of address instead, she to her this does not make sense !! I just dont trust what they advise after what happened last time. I told her this. So unclear her. I rang twice today as I forgot to ask first adviser and second one said something different. I know this is confusing but surely they must have some functional system in place for those who dont have a stable address and need to nominate one as I would, especially if Im doing permitted work. Best Regards
