PIP appeal

I have been advised by the appeal office at Sutton I can represent my son at his appeal on 26 March without him being there. Is this correct? I have already put the request in writing to the appeal chairman although at the moment the letter which was sent by recorded delivery and has been signed for it hasn't been put with the appeal papers. I am a representative (parent) not an appointee because my son refuses to allow anyone to be an appointee. I have to travel a long way to the tribunal and don't want a wasted journey.

We cannot answer your question as it depends on the chair of the Tribunal and whether or not they have been provided with enough information to enable them to come to a decision.
Are we talking about PIP or DLA?
If it is DLA then your son does not need to be there, PIP is different but I have represented claimants who have just come out of hospital and are unable to attend, the chair of the Tribunal had all the relevant information and I was able to fill in additional information, I always visit the claimant just before a hearing to go over details, just in case something happens. Todate we have been successful but you can never guarantee anything.
Be realistic with what you want to get from the Tribunal, the first question the Tribunal usually ask is 'what are you looking for', if you say enhanced on both components (PIP), then they will ask a lot more indepth questions.

Thanks for your response. I was talking about PIP. My son still refuses to go because he no longer trusts any one in authority. What we want is more realistic points because the DWP have made assumptions that are incorrect. I have submitted everything I can and explained the situation to the chair in my last letter. This is the one that he appeals office can't find although I have proof someone signed for it in their office. Thanks for your help anyway. I feel at this stage I have nothing to lose except the train fare from the North of England to Sutton

Your son will be expected to attend unless the Chair of the Panel gives permission for him not to do so. I had a relative who took her son, but then told the chairman that he was sitting outside stressed and didn't need to hear the discussions. The Chair never called him and listened to the mother. Make sure that you get that permission first - keep ringing up the Tribunals Service or his tribunal is likely to be postponed or dismissed altogether.
