Hi, i am filling out the form and have got to the questions regarding the mobility component. I am aware of the tribunal decision that has made the DWP accept mental health reasons for mobility and think i should have qualified when i made my claim (transfer from dla) back in dec 2016, at the time i asked for a mandatory reconsideration of their their decision but it didn't make any difference and i wasn't in the right state to take it to tribunal. I was in receipt of the mobility component when i was getting DLA.
So my question is... should i mention that while my condition has not changed how the dwp applies the law has changed because of that ruling? If so how should i put it? Should i also mention i want my original claim looked at as a newsletter recently says they are reducing the people they are reassessing from the 1.6 million they were originally going to. I don't want them to use this review as an excuse not to reassess my original claim.

It's up to you what you write, but I don't think there is any value in trying to tell the assessor their job with regards to changes in the law. Even if you're saying that your condition is unchanged then you still want to emphasise even if it's only in a couple of sentences how your condition/s impact on your mobility in relation to the specific PIP criteria.
