So upset does not even describe it was created by jaxw17
My Son who it 44 has Paranoid schizophrenia in a severe form. He has been sectioned twice and is on depo injections. He has just been reassessed for PIP he was on enhanced rate of both components. He has scored no points not even one.
I filled in the form with loads of detail covering all the points. His Dad and I took him as he would not have been able to go on his own.
She concentrated on all the physical things and I kept pulling her back to the mental health and how it affected him and his ability to do things.
He received this in the post today at the same time an application to look at his work capability claim.
I know I need to ask for an M.R and a copy of the report. what do I need to ask for do I need to give grounds on why we are asking for the M.R.
I have contacted our M.P. but don't know how good this is going to be. I have also contacted the mental health team who said he would come round on Monday when I ring the DWP I wondered if he spoke to them when asking for the M.R. it may help.
All this and we are going away on Monday for a well deserved rest as I know that many of your members will recognise.
I feel overwhelmed and have just spend all afternoon in tears

Hi jaxw17

You are not alone, I have seen some horrendous decisions which beggers belief.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your son's claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

www.benefitsandwork.co.uk/help-for-claimants/pip

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that your son meets the criteria, there are many reasons he may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that he walked 50m, he did but they have failed to document that he had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.
