ESA Contribution Based to Income Based was created by Kingz Arfur
Can you be moved from ESA Contribution based (support group) to Income Based if it would make you worse off due to a change in financial circumstances?

With one exception ESA(CB) is always paid if the claimant met the Contribution Conditions when they made their original claim. ESA(IR) can be paid as a top-up if the calculated ESA(IR) is more than the ESA(CB) that is being paid.
The exception is when the claimant is not in the Support Group, this includes the Assessment phase and time waiting for an appeal. In this case, ESA(CB) is only payable for 365 days. If the claimant is eligible for ESA(IR) then this can be paid in place of the ESA(CB). It is important to understand that the claimant does not lose their eligibility to ESA(CB), they are just not entitled to payment.
If you can provide more information we may be able to provide more information.

At the moment I get ESA (CB) Support Group since first claiming a few years ago. The calculation for income says income related income £218 with total income higher so no entitlement to ESA but because entitled to ESA (CB) we get ££.
Part of the income is £34.92 wife's wage. As she is due to stop work and the loss of this amount then makes income less than £218 will this mean I will be moved to ESA (IB) which would mean we are worse off? Sorry it's a bit complicated.

Hi Kingz Arfur
As you get CB ESA and in the support group then no matter what your partner earns their income is not taken into account you will carry on getting CB ESA until you are reassessed and found fit for work or put in the work group.
The difference is that legacy ESA was one benefit consisting of two eligibility criteria, one based on the claimant's NI Contribution history (Contribution Based ESA) and the other on their personal circumstances (Income RelatedESA).
New Style ESA only considers the claimant's NI Contributions, the equivalent to ESA(IR) is Universal Credit.
You can see how much benefit you might receive by putting your information into one of the online benefit calculators;
