Hello, I have just sat and listened to Boris and his money available for the employed.

My 13 year old son and I are disabled. I get PIP high rate on both and my son high care/low mobility DLA we claim working and child tax credits and so have the guarantee promise when we are migrated to UC.

My husband is a self employed gardener and as a diabetic is in the vulnerable group and so are most of his customers. I was hoping today we would learn that we would receive support so he could follow the instructions to self isolate.

However, as far as I can make out he will need to claim Universal Credit. We will then have our tax credit claim closed and moved across to UC and lose our migration guarantee.

Is there any other way of getting support? I do not understand new style ESA (I am on old style - in support group) could he claim ESA and not UC.

Or do we just update tax credits with his new wage for this year?? Potentially this will close our tax credits claim as a change of circumstances and we will have to claim UC

I guess my question is?? If he stops working as he has been told to do. Can we get any support such as 80% of his wage without having to go near UC??

We have had a very bad experience with UC when my son was moved from TC to UC and lost £100 when he lost disabled element because he wanted to work. On tax credits he could on UC he couldn’t.

Sorry about the length of this - I am worried my husband will get ill and HAVE to stop working

We're really not in any position to offer you advice on this.

If you are on legacy ESA then you may be able to add your husband to your claim by being "financially" reassessed for Income Related ESA. Contact the DWP office dealing with your claim and ask for an ESA3 form to be sent. This will not require a transfer to UC.

Your husband may be able to claim New Style ESA if he has paid for Class 2 NI Contributions, he will need a minimum of 50 weeks in both the Tax Years 2017-18 and 2018-19.

My understanding and I stress that this is not qualified is that there will only be a four week run-on of the Tax Credits.

Thank you for your reply Gordon, yes we can stay on tax credits for 28 weeks with my husband off sick and I hadn’t thought about adding him to my claim so I will look into that.
