Dla high rate mobility refusal? was created by Clare
Hello, my sons has been turned down for HRM depite overwhelming evidence to support it. He was awarded HRC and LRM. They seem to have ignored vast amounts of vital evidence and said he is entitled to LRM as 'although he refuses to walk , he doesn't walk but this is because he refuses to rather than he cannot'... How can l challenge this?

He has asd , adhd, anxiety disorder and a debilitating sleep disorder. He also had a blue badge. An ehcp and full time 1:1 in school .

Have you got the detailed assessment report?

Where were you expecting your son to score points that were not awarded?

I am assuming from the brief details it is a cognitive/mental health issue that prevents him from walking. You say that you had lots of evidence to support his mobility problems. Did this come from medical experts and did they clearly define this? If they did you can put in for a mandatory reconsideration and flag up the fact that evidence submitted was not looked at and reiterate that it is his mental health that inhibits his mobility and that should be taken into account.

Thank you for your reply. l had so much evidence l thought l had a strong case. He was given HRC and LRM untill may 2024 but l think he should have got HRM as he has a blue badge, an ehcp and consultants letter saying he needs close supervision and monitoring for his challanging fluctuating behaviour. Another letter from a consultant paed saying he is not concentrating when outside and has no sense of danger and needs supervision as he is a danger to himself and others. They seem to have ignored it all!

I keep hearing how l am risking the whole award by doing an MR but feel strongly they have made the wrong decision.

Hi, l wonder if you lovely people can help me .To cut a long story short my husbands buisness has taken a turn for the worse like many peoples jobs have due to Covid and currently he cannot work for the forseable future.
l am a stay at home carer who claims carers allowance for our disabled son, we also have a daughter who is disabled and have just put in a claim for carers allowance for my husband to be her carer. He was her carer previously before he started her buisness.

My husband is not entitled to the 80% wage grant so we have just claimed universal credit online and have our over the phone job centre appointment scheduled for next week.
l have had to deal with some unpleasent job centre staff before who have tried to force me to look for work depite being a carer and l am worried about how they will be on the phone hearing we are both carers? What can l say to ensure we are not made to attend work focused interviews etc? l am worried they will take quite a pushy stance and expect one of us to be looking for work, which is not possible.

Both children have multiple diagnoses and high care needs but jobcentre staff are often quite cold and can be intimidating. { no offence but that is my experience}

l would really welcome your advice on what l can say when we are both grilled in next weeks interview.

Just to clarify one child recieves high rate care dla and the other middle rate.

You can both receive the Carers Element as part of your UC.

You have overcome the first hurdle by each making a Carers Allowance claim, what I would expect you to have to deal with s showing that you are each providing 35 hours of care for your respective child, I realise that in reality that you will each provide care for both but you need to explain the care that you will provide to a single child.

In the short term, you are not going to have any issues with any interviews or job searching as it is all suspended, in the mid term I also think you will be OK as the JC+ staff will be interested in those UC claimants who are required to attend, in the long term, hopefully, your husband will have options about what he does or indeed that you do.
