Severe Disability Premium was created by Patsy19
I used to receive cb esa ,topped up with ir esa for myself and my husband. My husband now receives carers allowance for me ,our finances were reassessed and now I only receive cb esa. My husband is now entitled to daily living pip and I am too. I have read that we should be able to receive the lower rate of severe Disability premium. My concern is how do we claim it? Is it possible this would trigger a claim for universal credit? Thankyou

The SDP became payable from the first day that all three of the following applied.
1. You had an award of ESA and we’re receiving or were entitled to receive Income Related ESA.
2. You had an award of PIP Daily Living
3. You met the criteria for payment of the SD Premium, namely that you lived alone or were considered to be living alone and no one receives Carers Allowance against your PIP award or as a couple you can qualify if both you and your partner get a qualifying benefit (PIP daily living).
As you no longer receive IR ESA you will not be eligible to claim this premium, also your husband claims CA for looking after you, so again this would disqualify you, but as your husband receives IR ESA and no one claims CA for looking after him then he would be able to claim the SDP
Your husband should contact the DWP office dealing with his ESA claim and ask for the Premium to be put into payment, this will require him to complete an IS10 form, it should be possible to do this over the phone.

Hi Gary, my husband doesn't receive ir esa. I claimed esa for both of us but I only receive my CB esa as I have a private pension and the total amount we receive including my husband's carers allowance takes our income just above our needs allowance.

Thanks for clarifying, from your post I thought your husband was getting IR ESA.
As your are not in receipt of IR ESA but getting CB ESA then neither you or your husband would be eligible to claim SDP.

Sorry but I disagree.
You both (now) have an enabling award for the SD Premium.
One has a CA claim against it so it doesn't count but the other still does.
So you have an extra £65.85 to be added to your calculated ESA(IR) amount, this may still not be enough to enable payment but it may.
Contact the DWP office dealing with your ESA and ask to complete an IS10 form, it should be possible to do this on the phone, the form captures information about your living arrangements and the benefits being paid to see whether you are eligible for the Premium.

Thank you to Gary, and Gordon for your replies.
Could I possibly put this question to Gordon directly. Before I submitted my initial enquiry I thought we may be entitled to this premium aswell- at the lower couple rate as you say. I am worried if I contact the DWP the call centre may misguide me as has happened in the past with some queries. Do you know that if I successfully apply for the premium and it is refused for whatever reason - is there a chance they will close my esa claim down and I would have to claim universal credit? Thankyou.
