Just received letter regarding pip appeal which will be done over the phone. As original claim was based on mental health difficulties which included being unable to converse on the telephone as being Appointee and holding Power of Attorney over my wife how will this assessment be carried out. Can i do the talking or has her input got to be included which will be virtually impossible. If so where do i go from there.
You need to write to the judge now and explain that your wife has difficulties with the phone and the difficulties it could cause if she was forced to do so and ask as her appointee if you would be able to speak on her behalf - and see what the judge says. It is up to them. The judge may want to speak to her to hear her confirm her name and then be happy to have you speak, or they may insist that she at least tries. I can't say how they will proceed.
