Will my PIP stop? was created by traceytracey
Hi all, I hope you are all keeping safe & well
My PIP is due to end May 2020 (I won through a tribunal in 2017) . I received " a how your disability affects you " form in March which was returned on 17th march via registered post.
My question is this :-
(1) because i won through a tribunal it is classed as a new claim rather than a review, does this mean I won't get the extended time on my current PIP? and it will just stop as they say it is a new claim?.
Thank you in advance

Nothing on this board constitutes legal advice - always consult a professional about specific problems

Whilst the DWP may distinguish between a renewal and a reassessment the PIP legislation does not.
If no Decision is made on your claim by the end of May then your award will be extended, probably by six months.

Hello Gordon, thank you and all the mods and contributors on here for your excellent work.
Sorry to jump on this thread, however my question is about what you said regarding the legislation of PIP does not distinguish between renewal and new claim. I am in a siimilar position to traceytracey, having won an appeal nearly 3 years ago. The letter then from the DWP stated that they would contact me in November, or soon after, to see if anything had changed. Unfortunately I got nothing until late February saying that I now had to apply for PIP as a new claimant. We queried this and they just referred us back to the letter even though our letter to them said that although we wish to query why it was a new claim, that I wished to continue regardless. So they don't even seem to be following their own process they laid out after the appeal.
Does this mean they will ignore all the evidence they already hold and it all has to be done again from scratch? Just seems so very unfair after the mangle they put me through last time that the tribunal saw through quickly and gave the award that was in line with reality. I'm pretty worried they will send me to the same person I saw last time that I complained about because she had an A4 sheet right beside me that I could clearly read all the patients' names she had that day, their addresses and conditions. Nothing was done, complaint ignored, but I would feel too nervous to continue if I was forced back there.
Thanks and all the best

If you are being asked to renew your claim rather than being reassessed by the DWP, then you should treat it as a new claim as you will receive another PIP2 rather than the AR1 Review form, you will need to provide evidence to support your claim. new if possible but old if necessary, even if it has been sent before.
If you are asked to be available for a telephone assessment or a face to face one when the current crisis is over then you can contact the Assessment Provider to make sure that the assessor you mention is not used for your claim.

Hi Gordon,
Just to say you were correct
I called the DWP yesterday as I hadn't received a letter to say whether my award had been extended by 6 month or not. It has been extended til November and even then they can't say what will happen. I thought I would let you know incase other people are worrying because they haven't received a letter yet. they are just very behind at the moment.
Take care
