help desperate cb-esa ir-esa and uc was created by karenwb9
hi
desperately need some advice please regarding cb-esa and ir-esa and uc
here goes hope its not too long winded, I will try to keep it short.
I am on cb- esa and in the support group have been ever since, (incapacity benefits since 2002 migrated onto cb-esa) My husband has been on CB-esa since January 2017 also in the support group. we are both on pip (thanks to BW) enhanced for both elements.
My husband has a small Monthly pension due to him being retired from work on the ground of ill health in may 2018, he also claims industrial injury benefit since 2016/17.
we are both carers for each other (we have underlying entitlement) although we don't receive any money because our esa is higher than carers allowance.
we are struggling with our rent and have gotten into debt which is why in August of last year we decided to apply for help with our rent through our local authority, only to be told we had to claim UC. I have never felt this was correct advice.
after a long drawn out process and more debt as we continued to pay the rent we were advise we wouldn't receive any help for rent and our payment for UC would be NIL, again making no sense to me at all. In march of this year and via my journal on UC site I had our claim for universal credit closed, they closed it from 31st august when we first applied. so currently we are still on the old style esa system.
We have since been advised (by a lady in the job centre) that we would need to fill in form esa3 and that we should not have been advised to claim UC. we should be entitled to some income related esa to top up our income and then apply for housing benefit(not via UC)
so we have 2 x severe disability premiums, no one is getting a payment of cares allowance to meet our needs, we should be claiming couples allowance disability rate, we have 2 carers premiums due to underlying entitlement. please can someone advise whether this is correct before we go filling out more forms only to be told its wrong. I am losing lots of sleep over it.
thank you in advance

Yes, plus the person who makes the Income Related ESA claim will also receive the couples rate for the Personal Allowance.
From the total calculated ESA(IR) both of your ESA(CB)s will be deducted plus your husbands IIDB and pension, providing there is still an amount of ESA(IR) to be paid you will be able to claim Housing Benefit.
You can put your information into one of the online benefit calculators to see if you would qualify.
