Dear Gordon
Can you please advise. I asked DWP to consider backdating my claim for UC for one month. I explained that am suffering from mental health issues and deep depression,this led to a delay in making claim for the correct benefit at the right time as there is still so much confusion with UC and new style ESA. I rang UC helpline few month before i have submitted UC claim and was advised do not claim and wait for PIP assessment. I am on ESA contributory and in the support group.
I received refuse today,they said we only backdate claims if one of the following reasons stopped you from claiming earlier:
✓ you have an illness or medical condition
✓ the Universal Credit online service was unavailable
✓ your claim with your ex-partner was not allowed or ended
✓ you were told late that your previous benefit award was
ending

Did you keep a record of the call that you made where you were advised not to claim UC? If you did and you can get a copy of the recording then you may be able to do an MR on the basis that the DWP advised you incorrectly.

If you don't then realistically, I don't think that you can backdate your claim.

I am receiving ESA because of my health condition and this is the reason that stopped me from claiming earlier.
What UC team meant by *you have an illness or medical condition*?
