Didn’t get AR1 was created by Dhoyle
Hi,
A family noticed that their PIP payment stopped this week so called them to see what was up. It turns out that it ran out in March!
They’ve had no communication from DWP for a long time. 12 months before mine ran out I received an AR1, they didn’t get anything.
DWP apologised on the phone today and told them to reapply. Is that right? DWP have clearly made a mistake, is there not a process to deal with this kind of thing?
Anyone had experience of this or can offer any advice?
Thanks.

Nothing on this board constitutes legal advice - always consult a professional about specific problems

You say "a family", is this someone you know or have you read or heard about this? Either way, there is not sufficient information to make a specific answer.
We have had a lot of posts recently on the forum which suggests that a lot of members do not understand the operation of Fixed Term awards so my answer is also aimed at a larger audience than just yourself.
Fixed Term awards are exactly that, an award for a fixed period of time, once the End Date is reached the award ends and no further payments can be made unless the award is replaced by another or the award is extended by the DWP.
DWP procedures should mean that they contact the claimant before the award ends but there is no legal obligation for them to do so, similarity, a claim form (either an AR1 or a new PIP2 form) should be sent to the claimant but there is no legal obligation for the DWP to do this.
So this family need to make a new claim for PIP, they will not be entitled to any payment until and unless a new award is made.
They should certainly complain about the failure to contact them but the best that they can hope for is that the new award starts the day after the previous one finished.

Thanks Gordon
For some reason I missed the word member, so my post should have read ‘a family member’.
Your advice was spot on, thanks.

4 years 11 months ago #248347 by Dhoyle An update on this:
The family member was sent a new claim form and was busy filling it out when DWP called to tell him that they’d decided to extend his claim by six months even though he was just outside the window for Clovid-19. So good result in the end, despite it technically being caused by DWP.
