Please can someone advise me. We filled in the PIP claim form using all your guidelines and recommendations but the HP who conducted the phone assessment was awful. She was rude, abrupt and the report is full of inconsistencies and lies. 0 points for everything which is shocking as we provided evidence and the person is in active heart failure with a terminal diagnosis and also has a rare bleeding disorder but because she is young ( 29 ) they have just not taken anything seriously at all. My question is MR...what do I do? I have looked at the guides but I get the impression that all you do is say that you want a MR and then wait for the decision before you can start an appeal and pull the report to pieces to show how wrong the report is. I this correct? Is all I need to do at this stage request a MR using your letter template/guidance or do I need to pick through the report pointing out all the inaccuracies now? Please help ...I am doing this for my daughter...she is desperately ill and needs this money as she has had to drop her hours at work to 16 per week due to her illnesses and is struggling to make ends meet. I hope any of this makes some sense...I ma just lost as to what I am meant to do next? She doesn't qualify for the terminal route due to life expectancy longer than 6 months. Thanks for any help in advance

You can ring and put in the request for a mandatory reconsideration. You should then follow up the request in writing and in your letter you should go through the report challenging the issues. Do not waste your time on things that will not bring your daughter points. That's not to say you shouldn't mention them, but you can put those points in a summary paragraph. Concentrate on all the questions that you thought your daughter should have scored for. You definitely want to do the best job you can and try and get it overturned at this stage. Don't rely on them just reading what you've already said - go back and direct them to the evidence you sent in and how you think your daughter meets the criteria.
One of the other members has reported today that the Tribunals service are saying they will now take between 52 and 58 weeks!
