This was the advise what I was waiting for because I want to withdraw in coming week but again thanks, will send this letter and wait for the outcome then will decide and also will updated you here.

To be clear on the procedure, you do not need to and should not withdraw your appeal, if you accept the DWP's offer then they will lapse (cancel) your appeal.

Hi Gordon
As Gary inform me and the lady form DWP also told me clearly if I accept there offer or not still its up to me can withdraw my appeal or take further to court. Haven't understand as you say they will lapse my appeal if I accepted this offer?

You have three options;
1. Reject the DWP offer and continue with your appeal.
2. Accept the DWP offer and take no further action, the DWP will then contact the Tribunal Service and lapse (cancel) your appeal.
3. Accept the DWP and once the new award is in payment request a new appeal, the DWP will then contact the Tribunal Service and lapse (cancel) your appeal. Requesting a new appeal will be exactly the same as before, you do not need to request a new MR.
As an aside, the Judge for your current appeal or any new one is obligated to warn you if the panel are considering reducing or removing your current award so that you can withdraw the appeal and retain the award in payment.
