Hi I currently receive old style contribution based ESA and PIP. My brother recently passed away due to Covid and I am handling his affairs. There is about £7000 in total and I would say about £1,700 will be used to pay of outstanding debts. If any more do come to light, which I don’t think so, it will be minimal so maybe £5300 left in his estate. This will be transferred to my mum as his next of kin. So my question is do I have to inform the DWP as I am not a beneficiary of his estate but they have to pay it into my account for me to pay his creditors, final utility bills etc and my mum as his beneficiary. The money will only be in my account for as long as it takes to pay out. I suppose my concern is that for a short while, with my own money, it will take me above £6000. The bank won’t pay it directly to my mum as I’m done as executor and she is the beneficiary. Obviously I will have full paperwork. Please could anybody advise how this could effect me as it’s worrying me at a already stressful time. Many thanks for any assistance given

First of all, if you are only receiving Contribution Based ESA then there are no capital limits and the inheritance will not affect your ESA, as long as you are only receiving Contribution Based ESA and no Income Related payments then your savings and assets will not have any effect on your ESA(CB) and you do not need to tell the DWP.

If you are receiving any Income Related ESA and the payment will take you above the £6000 limit then there may be deductions from your ESA(IR). If as a result of the payment your total savings and assets exceed £16.000 then your ESA(IR) will stop.

I assume you are in the support group, if not then your claim for CB ESA would stop after one year.
