28 days in hospital was created by Richie L.
I’m approaching being Hospital for 28 days. I get full pip via the DS 1500 form and ESA.

What happens after the 28 days maximum stay to my benefit please?

Hi Richie L.

First of all PIP, payment of the awards is suspended, the actual award remains in place as long as the claimant continues to meet the criteria.

There is no suspension for the first 28 days in a hospital or a care home.

After 28 days the Daily Living component is suspended if the care is being funded by the NHS or the Local Authority. It is not suspended if the claimant is fully funding their care.

After 28 days if the claimant is in a hospital then the Mobility component is suspended.

ESA can sometimes continue to be paid indefinitely without being reduced. However, the disability, enhanced disability and higher pensioner premiums in income support ( and any premiums and additional components in income-related ESA) are stopped after 52 weeks.

If your PIP stops, it will be paid again as soon as you come out of hospital. If you come out of hospital but have to go back in within 28 days your benefit will stop again as soon as you are staying in hospital again.

Richie

Just to add to Gary's advice.

You must contact the DWP if go over the 28 days, the days you are admitted and discharged do not count towards the total, of there will be a recoverable overpayment.
