Hi I was on Enhanced rate no mobility but December last year I had a bad accident sustaining a patella tendon rupture where now I have walk with crutches and a knee Brace told might told might never able with out them again so I reported this as a change of circumstances to claim mobility I also have other disabilities like falling all the time then I had a phone assessment I told them I will have somebody with me because I am totally deaf in my left ear and I only got about 40% hearing In my right ear the outcome was disgusting they dropped my enhanced rate down to the standard rate and no mobility because they said I can walk 50 Metres to 200 metres total lie so how do appeal

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.
Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;
"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"
than their opinions
"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

Hi Gordon just let you know I did tell them on the telephone assessment that I could not walk more than 10 feet without stopping with being breathless and pain in my knee which end of the day I had to put ice pack on due to the bad swelling also told i’m not getting the oxygen in my blood nearly had heart-attack or stroke while in the hospital I was put on oxygen for four days this due to working in the cardboard Industry in the 70s and 80s and 90s wearing no masks and breathing in lot of cardboard dust I told her this other and other again and about my accident to my knee so I think she did not put this in the report on purpose but will do as you say and appeal thanks peter
