Advice re reapplying for pip was created by lmc77
Good morning everyone hope you are all doing ok. I have been through all stages and now at Appeal stage. I was wondering, now that I have physio report that completely contradicts the assessment would I be able to reapply or do I have to wait for the appeal?
If I applied and was successful would I still be entitled to the back pay that winning at tribunal would trigger?
Thanks in advance

Hi Imc77
If you were awarded zero points you could stop the appeal and you could put in for a new claim. Bearing in mind you will still be assessed and they may well look back at your prior claim.
If you get awarded on a new claim, it will not be backdated as a tribunal decision would be - simply because it is new.
If you have been awarded some points for PIP already - then you can stop the appeal and any award you have will stay as it is.

Just to clarify things further.
If you have no award currently then you can make a new claim for PIP, you do not have to cancel your current appeal to do this but if you do not then any award made by the Tribunal will be what is called a "closed" Decision, this means the appeal award will only be payable until the day before any Decision is made from the new claim and it will be this new Decision that is carried forward, whatever that new Decision is.
