I recently won a 4 year award from a PIP tribunal to April 2024.When I received the documentation from DWP regarding backpay and on-going payments they said that I can be re-assessed in April 2023 which is 12 months before the Tribunal award.Can they do this?
Unless there was something specific in the judgment that you should not be reassessed before a certain date - then yes, they can do this. The DWP says they will normally review a year before the end date - in reality, it has been happening about 6 months before the award end date - but the official guidelines remain a year.
