Hello, I would really appreciate some help here. I have recently found out that my sister was refused PIP last November when she assessed. She was on an indefinite DLA award as she has a serious mental health diagnosis, which is life long. Because of the way she was treated, she didn't tell anyone that she hadn't been awarded, the process made her feel like a liar and a benefit scrounger, so she just put it to the back of her mind. She has subsequently tried to live a 'normal' life, but she cannot leave the house, cook a meal or socialise at all, she is completely paranoid and has delusions which cause her trauma. three weeks ago I had to go a get her and move her into my house as she was so traumatised and confused. Sorry about my ramble, but here is my question:

Could I help her to make an appeal under exceptional circumstances against the decision last November. I can get the forms completed and gather evidence from health professionals, but i don't want to put her through even more stress at the moment if its not worth it. I would also like to know if there are any mental health advocates that could support such an appeal.

i am furious that she has been treated like this, it's inflicted actual psychological harm and I am glad that I found out and was able to intervene, otherwise she could have been sectioned or even dead by now.

Hi AJH

You can put in for a late Mandatory Reconsideration and ask them to consider it under exceptional circumstances. From what you say her mental health was not good enough to do it herself and fear stopped her even telling her nearest and dearest. Try, and see what they say. If they refuse you should involve your local MP. Some MPs have been successful in helping claimants getting unfair decisions over-turned by contacting the DWP on their behalf. I can't tell you whether it's 'worth it' because I can't tell you what the outcome will be but in a similar position I would try. Your sister's mental health issues have not disappeared.

Hi AJH

I have done quite a few late MR under exceptional circumstances, you have up to 13 months, as BIS has stated ask them to consider it under exceptional circumstances mental health.

The last two I have done we had to appeal the decisions but won both of them at tribunal even with a DWP presenting officer present.

The first thing you need to do is start the MR due to time limits, once you start the MR you can then check your area to find a local welfare rights worker such as Derbyshire who will be able to help you, other local authorities may also have welfare rights workers.

Does your sister have a CPN or Psychiatrist that could write you a supporting letter?
