I had my telephone assessment on the 6th November, the lady was very nice and she had a trainee in with her. I was asked the day before if it was ok for the trainee to be present, I said yes and I didn’t hear her at all during the process. The assessor said that my doctor had sent a lovely letter in and that she wanted to get me the highest award possible. I woke up to £955.20 in my bank today. I haven’t had my brown envelope yet but have worked out that I got awarded standard living. In 2018 I lost enhanced daily living after an assessment and prior to that I lost DLA in 2008 and had a horrendous appeal which put me off appealing the 2018 loss. Using this website I got the help to get PIP awarded again but I feel that I should have got the enhanced again as I have more going on now than I did when I got PIP in 2013. How do I go about asking them to reconsider and will my Universal credit change up or down by getting the award, also can I get anything else awarded. I hope that doesn’t sound like I’m being greedy but I have a lot going on health wise and it is well documented. I feel I also should have got mobility as I have spondylolisthesis grade 4 and SI joint dysfunction but I’m assuming that because I’m upright that I don’t qualify.

It is nice to hear that you had a good experience with your telephone assessment.

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration but I would wait until you have a copy of the Assessors report (PA4), this needs to be done in writing to the DWP, within one month of the date on the Decision letter, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.
