Hi, can anyone tell me where I would stand on inheritance issues? I'm on ESA income related.
I live with my mum, always have & she's stated in her Will that I am to receive the house when she passes away, she owns the house outright. I know I would need to sell and move straight away as the house is too big for me, neither could I afford to stay here & the plan would be to buy a small house for myself. If I did this and didn't have any savings over £16,000 would I still receive my ESA? Or do DWP cut me off because I will need to sell up & move? There is also a possibility that my mum might take out a small amount of equity on the house but put inheritance protection on it so I still receive a percentage to inherit to hopefully allow me to buy something. Would really appreciate some input on how DWP would view this? Thanks.

Hi Lottie

You should seek advice from your local welfare rights worker who will be able to take all your circumstances into consideration when giving you advice.

If you are receiving any Income Related ESA and the inheritance would take you above the £6000 limit, then there may be deductions from your ESA(IR). If as a result of the payment your total savings and assets exceed £16.000 then your ESA(IR) will stop.
