Can anybody advise me on what I can do? I applied for IR ESA from CB ESA.
I asked for my claim to be backdated for four months and they have refused. Apparently, they only backdate payments for up to one month. What kind of evidence can I send them if I decide to ask for Mandatory reconsideration? Iv'e already sent savings book, bank statements, tenancy agreement with forms, ESA3
LTF1 and IS10. Thanks in advance.

Hi Diff

When you say you applied for IR ESA and CB ESA, when did you apply?

The DWP are correct, backdates usually only go back one month, if you want to go back further then you may be able to ask for an 'Any Time Review' you can ask for this if there has been an official error, para 5(a) of reg 3 of decisions and appeals regulations.

I would suggest that you seek advice from your local welfare rights worker who would be able to take all your circumatances into consideration and may be able to help you.

Unfortunately this forum is not able to go into specifics, we can only give general advice or point you in the direct where to get specific advice from organisations such as Citizen Advice, Shelter etc.
