I have set up a Disabled Persons Trust to purchase a home for a family member, in receipt of Universal Credit and PiP (recently disallowed but they are appealing). Can they receive rent money as part of their Benefits, in order to help pay towards maintenance of the house? The 'landlord' is the Disabled Persons Trust, set up solely for their benefit.
I have worked with a gentleman whose father left him a house in just such a trust. The house is owned by the Trust and he rents it from the Trustees and claims housing benefit to do so. The Trustees use this money to maintain the property. This whole arrangement has been set up by a respected local firm of solicitors, one of whom is one of the Trustees, so I have no reason to suspect that there is anything amiss. Obviously his claim for Housing Benefits is subject to all the usual checks as to whether or not it is a reasonable amount for the property being rented.
