I applied for a change in condition. My health has deteriorated namely heart and lungs. I already have a pacemaker. Spinal stenosis, osteoarthritis with osteophytes, scoliosis, prudential nerve damage with voiding dysfunction, poor balance and get spasms of legs, feet, hands and lumber spine. I got 4 points and her references were to the previous forms not current. I suffer ptsd after sons suicide many years ago now and have anxiety and can have panic attacks. I don't know what to do now as I'm so restricted

Hello Jacinabox,

I am sorry to hear that you have to live with so many horrible things.

I am assuming that this is a question about PIP, please do come back to us if that is a wrong assumption.

If you have not done so I would suggest that you start by reading, or rereading, our guides.

PIP resources

The first one, which is quite long, but is very good, explains how the award works and how you are awarded points. If you scroll further down the page there are some specifically on how to appeal or request a Mandatory Reconsideration (MR).

If you have not already contacted the DWP and asked for the PA4, which is the assessor’s report you should do so. This is the document which you will need challenge.

I go through it with a highlighting pen, marking what I think they have got wrong. (It is important to only bother marking things which will make a difference to how many points you are awarded. For example if they keep spelling your name wrong, this does not reflect well on their professionalism, but is not a points scoring matter.)

Having done that, you can request a Mandatory Reconsideration. This telling the DWP that you think they came to the wrong conclusion about how your conditions effect your Daily Living and Mobility and asking them to have a look at it again.

There is lots of help in the guides as to how to do this, but remember it is no good just saying that they got it wrong, you need to say what your reality is and give examples.

If you can get them, you can include additional letters of support with your request for a MR.

It is important also to focus not on what your conditions are, but what effect they have on you. For example, a diagnosis of Spinal Stenosis will not get you any points, the inability to reliably stand up and walk more than a few metres without stumbling, albeit caused by spinal stenosis, will earn you points.

Hello Jacinabox, I'm not a mod but I would also say if the assessor was definitely working off previous forms and NOT your recently submitted one, you have cause for complaint to IAS/ Capita that the assessment was not properly conducted and should be re-done, try also complaining to DWP if this was the case. As far as I can see complaining can't hurt if you have good cause, don't know if Mods agree??
But don't let it make you miss any deadlines, if your time/energy is limited the MR has to be first priority.

Hi denby

I would agree with you, but before putting in a complaint make sure you concentrate and get your MR within the time limits, once your MR has been put in, you can then concentrate on your complaint.
