hi mods, in reference to the change in law on mobility activity, i was assessed in january 2018 for pip after being on dla, i was awarded 4 points planning and following a journey needing prompting from another person to avoid significant mental distress, i received a letter in february 2020 concerning changes in law and it states i have been looked at again and my award is not affected , however since then i have been assessed again in january 2021 on a review and been awarded 10 points for planning and following a journey, but hcp states on bottom of assessment report other descriptor supported by some evidence and reasons why they have not been advised : past PA4 dated december 2017,notes he needed prompting to complete this activity however evidence from FME,HOC,IOS,SOH and medication suggests his daily symptoms would contribute significantly to presence of risk and vulnerability during this activity. does this new award give me any reason to request they look at my claim again regarding the new laws as my wife has been my carer and social support for over 20 years and has the experience required to look after my well being and safety many thanks bb.

This is a different process from claiming PIP and putting in an MR and then an appeal. The DWP looked at a number of claims after a change in the law - yours included. Your benefit was unaffected. If you were going to disagree with that decision, I think you should have done so within a month of receiving that letter (even though I don't think they would have looked at it again), as it is outside the normal process. You can ask for them to look again, but I suspect they will refuse. If they look, I don't think they will take notice of being awarded it on this occasion as many claimants could ask them to retrospectively look.
