Ask to be considered under PIP LEAP mobility ?

Hi

I have always believed upon movement from DLA to PIP....for which at initial decision and mandatory reconsideration I scored no points for any descriptor. Then to get enhanced daily and 4 points on mobility.

I was just relieved to get enhanced daily and so able for my wife to also retain carers. Both these benefits had been removed fir 7 months.

Thing is, my GP was always convinced that I should have retained standard mobility as I'd had on DLA. I hadn't been aware of this LEAP exercise where claimant's awards are being reassessed due to court ruling. Now I've just had a PIP.1043 Award Review to complete. I'm terrified again. The most realistic descriptor has always been F for inability to follow any route unaccompanied - 12 points. Guidance was apparently different in 2015.

Do I just press on with award review. Or do I ask them to also look at my tribunal result in light of the 2017 court ruling. The most important thing is maintaining a daily care award which also gives my wife carers allowance.

Don't know how all this is being dealt with now, especially with severe mental illness. Any advice appreciated.

There are two separate issues here:

1. Are you eligible for a mobility award due to the LEAP review?
2. Your current review form.

1. The DWP are reviewing a list of claimants who did not get a mobility award. This process has been ongoing since 2018. You don't have to contact them, - they should contact you, but there's nothing to stop you asking www.gov.uk/government/publications/perso...rom-28-november-2016. They have said that this will take some time.

2. You should complete your review form now and reiterate how your mobility is impacted by your mental health.

Hi BIS

My condition has been the same since end of 2006 but by the time I'd been stripped of my DLA completely and my wife her passported Carer's Allowance, upon reaching the Tribunal months later, I was shattered.

The wife felt we should have argued in regard to Mobility as the issues applicable to my award of enhanced daily living applied just as strongly to Mobility Planning a Journey. But I was running on low to a massive degree and the Tribunal had put me through a beating too.

You just go through life wanting to get by a day at a time. You never look forward to a PIP, ESA or any other review but in respect to myself it offers up an opportunity to revisit the Planning a Journey element in a better state than I'd been in 2015. Both the PIP Guidance and Legislation consider each aspect of my condition favourably for an award. Better than DLA descriptors and assessment criteria did if applied correctly by HCP and DMs. Apart from this the Equality Act 2010 has entire sections that back me in the ways I hope to now use more proactively.

I had initially walked into PIP assessment for transfer from DLA blinkered, with the idea in mind that having been on DLA and previously for a number of years in ESA and IB; that my arguments could be seen for what they were. Blinkered!!!!
