Hi,
I was first awarded PIP with both enhance daily living and mobility in 2013 I then had 3 papers based reviews ( I didn't ask for paper based review) with all resulting with high awards.
I filled my pip renewal form with gp letter and other evidences and 4 months ago I had my telephone assessment. My main health conditions increased but the difficulties I face everyday have not changed. I am on more medications, had 2 surgeries since my last review ( resulting even more pains and complications ) .
My PIP daily living is now standard and mobility is same.
I scored 14-16 points on daily living on my previous awards and now they only awarded me 8 points.
Decision maker says what the assessor input for me. I was so angry and upset to read lies that assessor said.
e.g : i can set up direct debits , so 0 point for budgeting.
I explained to him that my husband has to deal with all the money matters, tasks etc because I can't etc etc...
There are other few descriptors that I should have scored points or scored higher points.
After reading your guides and posts from forum, I understand I should not focuse on how assessor lied. But how can I write a MR letter without me keep saying " I never told this to the assessor " or " assessor lied" etc. They took my points away from where assessor lied.
Does it matter how many pages my MR letter will be? Can I include all my existent evindences again?
Decision maker also said " I know you wouldnt be surprise with your new award" . I was absolutely fuming then started to cry...
I am living with chronic pains and on morphone and many other strong pain killers and medications.
Other thing that decision maker mentions " although you have chronic pains, you told the assessor that your conditions are stabilised. " . I never said that . I explained all my difficulties on day to day basis and why.
I don't want to loose any more of my award after MR but I cannot let them take my points away with lying etc.

I'm sorry that this has happened to you.
It's frustrating when you receive an assessment peppered with lies, but it won't help your case to say so. Take each point at a time - and do the counterargument.
eg: Budgeting
"The assessor has noted that I can set up direct debits. They are mistaken and I explained during the assessment that my husband has to deal with all money matters. My husband does this because of X"
(X = your reasons why you don't budget. Explain why you can't do it (eg mental health difficulties, or pain affecting concentration...). Don't imply you don't choose to do it - or you are unlikely to score points)
Tell them what you scored previously and say that your condition has not changed. (You can repeat that after each point you are challenging)
In the final paragraph, you can say that you are disappointed in the standard of the report as the assessor (health professional) did not record what you said accurately and has made assumptions that are wrong. (That's the polite way of saying that they are a liar or incompetent or both!)
You don't need to send all your evidence again - but you can under each point quote from anything.
You said the difficulties you face daily have not changed. I don't know whether you said that to the assessor or wrote it on your review form, but that could be why she said your condition had stabilised. Make sure that you counteract this and say that they misinterpreted this or you never said anything of the sort - and then explain why you would not have said it. (more pain, more complications).
If you really feel strongly about the assessor lying, you can always put in a complaint to the assessment services. This will be dealt with separately from your MR.

Firstly, I never said I can stand 5 minutes. I said I cannot stand safely without feeling dizzy and can't keep my balance. Therefore I cut myself few times . I forgot pan was hot and I burnt myself too because of my health conditions and medications that I take make me unsteady on my feet, dizzy and cannot pay attention or focus.etc..
Do I have to have a medical assistance for me to score points on this descriptor? I am so confused.
Decision maker letter is consist of " you said X but HP said Y ; therefore you didn't score points / your points reduced.
Can I only go through each descriptors that HP lied about and DM reduced or removed my points as per HP's assumptions ( basicly lies)?
These are the descriptors that I scored very high points on my previous reviews and I struggle so much or i cannot do the task as safely etc.
Can I say at the beginning of each description that HP noted X but actually I said Y..And then explain in more details ( how you told me on your reply)? .
I don't want to keep reading I said X but HP note Y.
However, he lied on 7 descriptors which all effected my points.
I hope I make sense. I have been crying since yesterday alot.

If I change my mind to not to ask MR and leaves the points as they are ( 8 for standard , 12 for mobility) ;
will this look bad for me ? Will it look like that I accepted what HP said against originally what I put on my renewal form? I am sorry if I sound stupid.

It is very common for decision-makers to say that you did not need medical assistance when you burned yourself - so it wasn't serious. Remember this is only an 'opinion' and one you can refute. The decision-maker is not a medically trained person. Of course you would go to hospital if you couldn't stop the bleeding from a cut or if you burned yourself so badly - nothing would stop the pain - but you can still hurt yourself on a regular basis and deal with it at home. The point you want to make is that you cannot do these tasks safely or reliably and therefore you are at risk of hurting yourself due to your medical conditions and medication. (Yes you can be awarded points without having had medical assistance).
You want to make the point that the HP could not see you or examine you and has made assumptions which are entirely incorrect. Cite any evidence you have. Point them to what you said on your original form and what you said in the interview.
Yes - at each point you can say what the HP said and tell them what you said. Point out how different it is and what the difference means against the PIP claim. It doesn't matter how often you repeat it.
Don't bother arguing any point where you wouldn't score points.
It doesn't matter whether you decide to go for an MR or not. Plenty of people don't on an occasion because they're too ill, or can't face it and then wait until they have another review to hammer home the points.
I know you are concerned about losing your current award. It does happen, but only very rarely. I have only ever known of two cases where they had their award downgraded at MR stage and they were unusual. However, if you want to leave it, then that is of course your choice.

I cannot thank you enough for your valuble advises.
After reading my award letter, I was having an anxiety attacks ( I only get them when I am so upset or stressed)..
My husband and I were left speachless.
I will openly say this was an telephone interview and HP didn't see me how much difficulty I was in. I had change my position often duringthe phone call ( had to lay down, sit up, lay down again because of my chronic pains ).
I just wanted to finish the interview therI didn't ask HP to stop. I was left with more fatigue and ill afterwards.
DM says " I was communicating with HP and I was friendly . Therefore I can have no problems with X , Y , Z descriptors."
I will ask for HP report as soon as I can . However, my award letter clearly states what HP said and how DM just believed him blatantly.
