Hi Teddington

When you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and you will then be able to argue against them.

I usually use a highlighter to highlight any inaccuracies, once you have gone through the report you then set out why you are applying for a MR and go through each descriptor one at a time why you disagree with the assessor and try and match it with any supporting documents you may have sent in.

Understand that the assessor is offering an opinion when they say that you can do the PIP activities, tackling these head-on is unlikely to be successful, you need to show that the basis of that opinion is founded on incorrect information, so try and refer to your evidence to undermine what they have said.

Also, try and stick to issues that lead to your scoring points, I often hear members referring to the assessors spelling, as an example, whilst it may show a lack of professionalism, raising it as an issue isn't going to help you get an award.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

Lastly, make sure that you understand the criteria that you are being assessed against you can put the best case forward that is possible but you won't score points if you do not meet the PIP Descriptors.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide, half way down the page for details of the process, the PIP area also has template letters that you can use to make the request with www.benefitsandwork.co.uk/help-for-claimants/pip or you can use form CRMR1 www.gov.uk/government/publications/chall...ork-and-pensions-dwp

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.

Hi
It will not look bad on you at all. DWP, are trying it on, it is happening to all of us.
Mine was also full of lies, but I recorded my interview, I am now in the process with a Tribunal.
I sent my evidence to the Tribunal. The reply has been positive. The Judge mentioned how the DWP's evidence made no sense at all, and again had been very sloppy.
I would get How Your Illness affects you form, there will be stuff on there to back you up. I bet in the report it says [ They never mentioned this in their application, or at the interview] You will be able to show that you had written it down. Good Luck

Good Morning,
I've requested my health assessment form 8 days ago ( Inc. weekend) . But I haven't received it yet.
I rang PIP today and he said it has definitely been sent to me and I should receive it within 10 working days. I said, if I want to do a MR request then I will not have much time to write my letter etc..
He asked me if I want to do a MR request definitely because if I do then he can write a note saying I will be doing it. He then said, " you don't have to worry about the time limit to send your letter ( doctors letter if you have any ) to us. "
I asked him when shall I send my request by because I don't want to send too late unknowingly. He said " within 6 weeks would be good" .
I was very pleased to hear it.
After the phone call, I've received a text from PIP saying:
" You've asked us to look at our recent PIP decision again. We will write to you once we've done this. As a guide you should hear from us within 10 weeks. You don't need to contact us unless any of the details you gave us have changed." .
I haven't even received my assessment report to write my MR request but text says they will start looking at it already.
I am very confused and stressed because he said I have about 6 weeks....
What is going on , can you please help me ?

Thank you so much.

Hi Teddington

I'm sorry this is causing you such stress. I can't tell you exactly what is going on and you need to confirm this with the DWP. When you ring them, make a note of your conversation and whatever you are told - you need to then send off a letter - so it is on record. You are right you don't want them to just look at your case again without you having the details of what was in the report - so you need to confirm that you have the time to reply and a decision will not be made without them taking into account your views of the report.

Hi Bis,
Thank you for your reply.
I rang back PIP again today. I explained what I was told and mentioned about confusing text message.
I told him that I don't want them to make any decision until I send my MR letter explaining why I don't agree with assessor's report etc .
I said , I need to look at the assessment report first to be able to write my MR letter etc.
PIP contact centre advisor first checked this morning's note. He said " I am writing another note saying that you are waiting for your assessment report and you will send us extra information after receiving your report."
He said I have 4 weeks from today's date until I sent this extra information. ( I was told I had 5 weeks this morning).
I hope I receive my report very soon though ( although I am not so looking forward to read it ).
So, can I ask you if I understood correctly;
1) I will follow up my request in writing. What shall I say? Can it be a short letter?
2) Once I receive my report, I will write my detailed MR letter explaining why I do not agree with the decision etc.

Have you got any other advises for me which I should do meantime ?

I am so sorry for being so stupid and asking ( probably very easy/ self explanatory ) questions to you.
Thank you ever so much for your help.

Hi, I would also be checking if you can what date the report was submitted to DWP by the assessor. If it was more than the proper 48 hours, you may consider adding in your MR arguments that any omissions in the report could be due to the assessor not remembering the interview accurately after their delay. This casts doubt on the validity of the whole thing, if needed.
best wishes and do not let them get you down with their shenanigans!
