PIP tribunal winner, now penalised? was created by Maria Gavin
Hey all, I've been on PIP for 6 years and my conditions are worsening. After 3 years I received a review form but this time I've had a letter to say my claim is ending. When I telephoned it sounds like I'll be making a completely new claim (haven't spoken to a human yet, but recorded message suggests this). Googled it and CAB says this happens if you've challenged in the past. I won a tribunal on the mobility question last year.
All of this feels very much like intimidation and punishment for challenging them. It's sent me into a complete psych mess.

Hi Maria,

I had the same thing.

It is normal practice that when a tribunal has awarded you PIP then it has too be a new claim when it ends. You are not being penalised it is the correct procedure i'm afraid. I believe that then If you then get pip not through a tribunal then in future it would just be a review form .

Good luck

Hi Maria, I did my PIP ‘renewal’ recently, and like you I won at Tribunal last time. It was treated as a ‘new claim’. My PIP was stopped at the end date, but luckily I was successful so my PIP was back-paid (still waiting for them to sort out my Severe Disability Premium (SDP) though. Mine only took 3 weeks, but I spent 3 months on my application before phoning up for the forms.
As soon as you phone you get 28 days from your phone-call to DWP to return the forms. Get as much medical evidence as possible to confirm your claim. FUNCTIONALITY is what they are after, but obviously list any conditions also.
On a positive note the ‘new claims’ are being prioritised. Your claim will end if not decided before the end date, but you will get the money back once they have reached a decision.
Good luck. I read the guides on here, but also got Fightback and my sister to review my form. I understand your stress. Use the info from your Tribunal as well as new evidence. It will all help. If they refuse for any reason, they have to justify when you got magically better. Also list past awards history including DLA. Good Luck.

Hi.. Also Maria, on my Application I put the number of points I was awarded at Tribunal IN CAPITALS at the top of the ‘description’ for EACH activity along with the Tribunal Award date. (not the nil points ones obvs).
