Over 65 receiving PIP Notifying health changes

My health is deteriorating and I need to notify DWP so that I can claim Mobility in addition to my Care component. I've been on PIP/DLA for many years
I've heard that over 65s may lose PIP entirely on grounds of age if health changes as they are judged ineligible and then have to apply for Attendance Allowance.
I'd appreciate clarification/reassurance please. Thank you

Hi Alwall

If you do not already have a mobility award for PIP or if you only have a standard mobility award for PIP a claimant cannot increase that award after the age of 65.

Thank you, please can you provide a reference for clarity? I am unable to find it either in the Pip Guide or the Disability Rights Handbook.
There seems to also be an inconsistency considering I had to apply for transfer from DLA to PIP when I was aged 68 just over 3 years ago.

Hi alwall

Welcome to the forum, you might want to have a look at the following FAQ which explains where everything is.

If you are awarded PIP, it can be paid after reaching State Pension age, as long, as you continue to satisfy the entitlement conditions.

Unfortunately you cannot be awarded high Mobility as a new or an increased award after you reach the relevant age with the exception of the initial transfer from DLA to PIP where the age restriction is suspended.

The relevant age is 65 or State Retirement Age, whichever is the higher. If you have a Mobility award before the relevant age then you can continue to receive it after as long as you continue to meet the criteria.

MRs and Appeals remake the Decision being challenged and apply from the same date so if the MR or appeal takes you past the relevant date you can still receive the Mobility Component if awarded as long as the original date was before.

If you have the latest Disability Rights Handbook, Edition 46 you can find the information on page 26 box B.5, alternatively www.gov.uk/pip and www.citizensadvice.org.uk/benefits/sick-...ming/if-you-get-dla/ have information on moving from DLA to PIP.

Thanks Gary. I can now see that PIP Reg 27 is barring me from claiming. I also discovered that until the loophole was closed Reg 26 allowed some people over 65 to claim but the law was changed about a year ago.
