My son and his partner have split up so he's had to make a new claim for Universal credits. He was getting ESA (support group) PIP at the standard rate for both elements, and carers allowance for looking after me as I'm disabled. He's been told by one DWP member of staff that he can't get the carers element of universal credits, as he's getting some other element of universal credits (I'm not sure what). However, another DWP representative said that he was entitled to the carers element if £160-odd a month. I've been on a few benefit entitlement web sites and put in my son's details. They all come back with the same results. Universal credits £460-odd Universal credits plus carers allowance £292-odd, plus PIP of £300+ per month. Does he need to make a separate claim for Carers Allowance?
The DWP member of staff told your son correctly, If your son is in receipt of UC and LCWRA then he will not be able to claim the Carers Element, £163.73 pcm. UC regs, regs 29 - 30
Your son could claim Carers Allowance but it is a taxable income and would affect his UC claim.
I would advise you both to seek advice from a Welfare Rights Organisation, depending on your circumstances both you and your son may be better off if he did not claim CA for looking after you.
