The Dwp’s answer is because it has past the maximum 13 months for appeal that it shouldn’t be allowed to go to a tribunal. The way I see it the dwp are are picking and choosing what law they abide by when it suites them…
Well if they actually was going by the law in 2018-2019 I wouldn’t have leg to stand on with regards to my current complaint but Iv asked or more then one occasion for the evidence they received that triggered the award review they can’t find anything because there is nothing and also the amount of information they have been telling me over the that is incorrect is unbelievable but then again this pip…. Jeez should it be this difficult to get what you are entitled to when you have all the evidence to back up your claim….

Hi Natalie
I feel your frustration, it does seem that DWP make it as difficult as possible for claimants to be successful.
I attended an online tribunal today, we attended with zero points for both components from the assessor, zero points both components from the decision maker and zero points both components for the mandatory reconsideration, the client asked DWP for the assessors report (PA4).
When we received the report it contained lots of inaccuracies, I went through the report with my highlighter whilst talking with the client on the phone. I then completed an online appeal on the 15th July 2021 and put in a submission as to what I believed the client should have been awarded for each descriptor.
The result today, enhanced daily living and standard mobility which is what we predicted, we should get the decision letter within a few days. It only took 2 months from online appeal to Tribunal date.

The dwp are a shady bunch of people. I couldn’t find my original award l letter from April 2019 so I rang them and oh dear me he couldn’t of been more rude if he tried asked me on more then one occasion why I want it and with a big deep long sigh finally agreed to send it out. As far as I’m aware I have a right to request it and I have a right to have another copy sent out. He probably looked at my notes and was like herm this is not going to end well. I remember bits of its like I have awarded you from today because you didn’t know the medical evidence you sent it could change your award. Well as Iv said before I didn’t send any extra medical evidence in they went on a past medical assessment that was overturned at a tribunal.
Iv also just received a text saying they have received my request for a telephone conversation that happened at the beginning of august 2019 the one about an offer and her saying you can’t appeal the decision basically I’m getting all the evidence I need to show that what has happened has been unlawful and so wrong.
You really need grit and determination with this corrupt department and there dodgy tactics.

WooHoo Gary well done!
This is such great encouragement for all readers by proving [yet again] how wrong the assessors and DWP choose to be. They must, must be working on 'if they do it so often a chunk of the claimants will fall for it'

Well just heard about challenging the decision and it was a big fat no coz it was outside the maximum 13 months limit well at least I can say I tried and will definitely be more alert from now on.

Sorry to hear your bad news, yes 13 months is the absolute time limit.
I have helped a number of claimants who were very close to the 13 month time limit.
