Pip appeal was created by pat_burton80@hotmail.com
Hi. Could you please give me some reassurance. I had my appeal over the phone today. I was called by the clerk who explained what the procedure would be. He asked if I had my bundle of papers in front of me, which I had, he said I was the first today that had. Anyway he then started the recording the Judge came on asked me one question he asked the dr and disability specialist if they had any questions neither had, then said that my appeal papers were so detailed that they could make a decision on what I had supplied. My question is if they didn’t ask me anything does that look favourable for me or not necessarily. They said I should get the decision the middle of next week. Weather I get this or not I can’t thank you enough for your brilliant web page and all the help you give. Thank you.

Hi samphire

Thank you for your kind words.

The same thing happened to me a few weeks ago, my client gave their name, the Judge said that they had already gone through our submission and awarded what we suggested in the submission.

I would be quietly confident that your appeal has been successful, let us know when you get the decision.

Gary

Hi Gary

Thank you for your response. That is reassuring. I will let you know. I have had an email this morning saying I should have my decision letter by the 27th. Once again thank you.

Hi samphire,
As per Gary, on several occasions I have represented clients where few questions are asked and the tribunal then make the appropriate award.
If the tribunal did not give you an award, without giving you an opportunity to speak this would be a serious error of law! Try not to worry. There is nothing you can do at present until the envelope comes through the door!
Good luck.

Hi LL26.

Thank you for your reply. This was my thoughts exactly as the judge only asked me the one question and said they were all in agreement with their thoughts on my case there was no need for further questions. I didn’t get the chance to say anything so I agree if they weren’t going in my favour I should have been given the chance to be questioned. Like you say just wait for the envelope to arrive. Thanks again.

Hi all
Just an update and a question please.

I received my tribunal decision letter today and it went my way. Enhanced on daily living and mobility for 5 years.
I’m so relieved.
My question now is, I will be pension age in 2023, my award now will run out in 2026 as I have been awarded by the courts the award will end in 2026 will I still be able to claim pip after that date as I will be retired. Thank you wouldn’t have got this far without your help.
