PIP Application - Partial Evidence Used was created by Castlerock
Hi,

In October 2021, I applied for PIP at the begining of my proper treatment for adult ADHD. I've been treated all my lief medicinally but that's it. The new consultants which I'm with have a professional team assessing medication, educating me about the condition and it's various elements etc... This started about the time I applied for PIP.

Mid April 2022, I receive a letter asking for a F2F Assesment. Upon sending them a "request for reasonable measures" asking for "a dimly lit room", "few distrations in the assesment room", "that the assessor is a Mental Health Specialise with a Background in ADHD". They responded by giving me a telephone assesment. The assessor was pleasant to talk to and seemed fairly attentive.

None the less, I recorded the enture assesment.

A week later I get a decision which states I get 0 points based on "how your disability affects you form"... None of the 40+ pages of medical evidence from NHS was taken into account, including OH documentation. The assesment wasn't taken into account either nor were my GP, consultants or Mental Health Professionals contacted.

I've already sent them a mandatory reconsideration request form from gov.uk Under what parts do I disagree with I wrote:

None of the evidence supplied was used in the decision. The telephone assesment was not used in the decision. Contact with my General Practioner or ADHD Consultants (SLAM and Psychiatry UK) was not made to find out about my condition. I was only properly educated about my condition from 12th October 2021 by the ADHD Mental Wellbeing Support Team at Psychiatry UK so the more accurate and in-depth information would be found in the information which you have overlooked.

I really don't understand why they've waited until I handed all the evidence in, prepared my GP's and Consultants etc... for their call so they knew it was coming as well as endure that pretty personal and grueling telephone assesment which left me feeling totally down about myself and how it all affects me.

Is this something typical which they do?

Either way, I fully intend on taking this to tribunal if they carry on with their antics.

Using a 2 page document out of the 40+ pages, doctors and 90 minute telephone assesment is jsut not good enough. On top of that ADHD is a dynamic condition.. It varies, much like alzheimer's you haev good periods and bad periods all different in time and frequency, so basing their decision on a form I filled in online without referencing the medical information which I submissted is ridiculous.

Hi castlerock

I wish you well with your MR.

You may have already got letters from your GP and consultants and sent them as evidence. If you have not then I would recommend that you collect these.

It seems that often no contact is made by DWP to medical professionals so the more you can get and submit the better. You would be best to assume that unless you send it to them they will not seek out external evidence.

I hope this helps

Regards
Pete

Hi Castlerock

I'm sorry that you have had such an unsatisfactory outcome. Did you get a copy of the assessment report? This is called a PA4. If you didn't get hold of it, you should do so quickly, because although you have submitted your mandatory reconsideration, if you haven't had the report, you won't know why they scored you zero. If you didn't have that information, you should ring the DWP and ask for the report and also tell them you will be sending further information for your mandatory reconsideration.

I know you asked for a 'specialist' assessor in your condition, but that doesn't happen for PIP. The assumption is that the professionals they use can assess all clients against the PIP criteria. Obviously, a lot of claimants would disagree with that assumption.

You ask if it is typical for them to ignore evidence -unfortunately it is, and it is something that causes a lot of distress to claimants.

Hi,

Thanks for all the assistance and messages.

I think I've just made things complicated for myself :-( As soon as I got my outcome which stated that based on the "How your Disability Affects You Form" I was awarded 0 points, I responded immediately without waiting for the Telephone Assesment result to be sent to me. This is because every time the DWP sends me a letter, its always back-dated by 10 days,, so I was running out of time and didn't want to miss the deadline.

I've just had the Assesment outcome (all 24+ pages of it) and it's utter rubbish. It's literally as if she copied and pasted the same thing over and over. Half of the information is missing, crucial points were missed out, points were ignored, such as my dad helps ne with my monthly finances and shopping as I forget or make brutal mistakes. I also told her that my dad let me know that he's still working full time to try and keep me propped up (he's 74!) and I absolutely hate this as I fele bad enough that he needs to help me, let alone can't retire as I'm rubbish at doing paperwork and other things. On top of this, theyve missed out about 30% of the important facts which I've mentioned e.g. being admitted to a psych ward for depression and anxiety (they said in the assesment outcome that I didnt!)

Although I've already sent in my MR, which was the response to their first assesment, can I send in an amended one as the Telephone Assesment is horribly inaccurate and incomplete? I sent my MR in based on the information they gave me, which was obviously incomplete so I was just going by their document. By the look of it, this seems like its by design to throw me off, but I've got an attention regulation problem, I'm not stupid and they probably think the latter.

Can I re-address the MR, or do I now need to wait for the MR outcome then go to tribunal? I'd rather the former as it absolutely terrifies me sitting infront of a load of strangers talking about my issues, let alone with my dad there as I dont want him to worry any more than he should as he's 74!...

Also note that I coverty recorded the whole conversation, so there's no escaping what they've missed. Do I need to transcribe this for them or can I send it burnt on a DVD as a MP3?

Any pointers would be handy!

Cheers,

Ade

Hi Castlerock

If you haven't had a decision on your MR, you could write an updated version. Whether it will be accepted, I cannot say, but it's certainly worth a try. Don't send in a transcript or a copy of the recording, because they won't look at it or consider it. Keep that for an appeal if you have to go for one and at that time you need to send them a transcribed copy.
