Hi MeLee

If you have applied for a WSOR, when you get a reply you have one month to appeal.

The answer to your question is no, hopefully you will get your paperwork before your WSOR, Read LL26 post www.benefitsandwork.co.uk/forum/10-dla-e...at-tribunal?start=12

Hi MeLee,
Despite being knocked back by the First Tier tribunal you can still apply to Upper Tribunal. You will need to fill out the UT1 form thst should have been sent out with the set aside decision.
You may need to address what was wrong with the FtT set aside decision, but the ground of appeal can probably be much the same as the set aside grounds. There is no need for great urgency. Unless you can argue a good reason you have 1 mth to lodge the appeal from the date of the set aside decision. But you have enough time to think about the FtT decision and how to counter this.
Just because the FtT has refused this dies not mean that there can't be success at UT. I am aware of many cases won at UT despite FtT set aside refusal.
I hope this helps.
